General Terms and Conditions 

1. Introduction

Please read these terms and conditions carefully before using any materials, information or services

provided by Huntly (“Huntly”, “we”, “us”, or “our”). These terms and conditions, which we may update

from time to time, apply to our website), emails, text messages, and social media accounts

(collectively, the “Platform”).

 

When you use our services, you confirm that you have read, understood, and agree to be bound by the

terms and conditions set out below (including our Privacy Policy).

2. Nature of the Platform

2.1 Huntly is an online marketplace that connects hunters and guests (“Hunters”) with game farms,

landowners, outfitters, and hunting operators (“Landowners”), acting solely as an intermediary

booking and payment facilitation platform. Huntly is not a hunting outfitter, does not own any game

farm, does not conduct hunts, does not provide firearms, and does not guarantee the availability of

species. All hunting activities are conducted independently by the Game Farms and remain subject to

applicable South African laws and provincial regulations.

3. Eligibility

3.1 Hunters booking hunts through Huntly must be at least 21 years old, comply with all applicable firearm,

hunting, and conservation laws, and hold the necessary licenses (unless under the supervision of a

valid firearm license holder) and permits where applicable. Huntly reserves the right to suspend or

terminate any account if false information is provided.

4. Platform Booking

When you book with Huntly, you agree that:

 

4.1 You confirm that all personal and booking details provided are true, complete, and accurate.

 

4.2 You meet all legal requirements for hunting in South Africa, including age, licensing, and firearm

permits where applicable.

 

4.3 You agree to pay all fees in accordance with the platform’s payment schedule, including deposits,

balances, and any applicable add-on services.

 

4.4 Your booking is subject to identity and banking verification. Fraudulent or misleading information will

result in cancellation without refund.

 

4.5 You agree to comply with all hunting laws, species restrictions, and platform rules, including prohibited

species lists.

 

4.6 You will adhere to the specific rules and safety protocols of the hunting farm or operator hosting your

booking.

 

4.7 You acknowledge that cancellations or changes are governed by the platform’s cancellation and

amendment policy.

 

4.8 You accept that hunting involves inherent risks and agree to the platform’s liability limitations and

indemnity provisions.

 

4.9 Bookings are personal and may not be transferred or resold.

 

4.10 The platform reserves the right to suspend or cancel bookings if fraud, non-compliance, or unsafe

conduct is suspected.

5. Booking Process

5.1 Hunters must select available hunting dates, provide details of their hunting group, choose the animals

they intend to hunt, and select any related add-ons during the booking process. A booking will only be

confirmed once full payment has been received. Hunters are strictly limited to hunting only the animals

selected and confirmed in their booking.

 

5.2 If a hunter wishes to include additional animals after the booking has been confirmed, they must notify

Huntly directly via email.

 

5.3 Any such additions will only be processed subject to approval and full payment being received before

the hunt.

 

5.4 Hunters remain restricted to hunting only the animals listed in their confirmed booking, and any

attempt to hunt outside of this selection will be treated as a breach of Huntly’s terms.

 

5.5 If animals selected in a confirmed booking become unavailable after payment has been made,

modifications or removals will be subject to Huntly’s cancellation and refund policy. Huntly does not

guarantee the availability of any species.

6. Payment Terms

6.1 All payments must be made in South African Rand (ZAR) using the payment methods accepted on

Huntly’s platform.

 

6.2 Bookings are only confirmed once full payment has cleared.

 

6.3 Huntly does not store card details and relies on secure third-party payment processors to facilitate

transactions.

 

6.4 Any applicable transfer or processing fees are the responsibility of the person making the booking on behalf of the group and will be deducted from refunds where applicable.

7. Pricing

7.1 Prices displayed may include daily rates, animal fees (which may vary based on whether the animal is male, female, or classified as a trophy) and add-ons. Final pricing is determined by the Landowner and confirmed with booking acceptance. Huntly does not guarantee animal availability, trophy quality, or success rates

8. Cancellation and Refunds

8.1 Cancellations and refunds are subject to the number of days prior to the scheduled hunt, as

determined by Huntly’s policy.

 

8.2 Any approved refund will be less applicable transfer or processing fees.

 

8.3 Hunters who fail to arrive for a confirmed booking (“no-show”) will not be eligible for any refund.

 

8.4 In cases where animals selected in a confirmed booking become unavailable after payment has been

made, hunters may:

 

8.4.1 Reschedule the booking with alternative species or dates, subject to the Host’s updated availability.

8.4.2 Select an alternative species of equivalent value to the animal originally booked and paid for,

8.4.3 Request a refund if they choose not to proceed with alternatives.

 

8.5 Huntly’s standard cancellation terms apply to all bookings:

 

8.5.1 No Refund: For no-shows or cancellations made after the scheduled hunt date.

8.5.2 Partial Refund: For cancellations made less than 30 days before the scheduled hunt

8.5.3 Full Refund: For cancellations made at least 30 days prior to the scheduled hunt, a full refund will

be issued, less any applicable fees.

8.5.4 Species Unavailability: If a confirmed animal becomes unavailable and the hunter elects not to

proceed with an alternative species, Huntly will issue a refund, less any applicable fees.

 

8.6 Refunds and modifications will be processed in line with Huntly’s policy.

9. Assumption of Risk 

9.1 By booking and participating in hunts through Huntly, hunters acknowledge and accept that hunting involves inherent risks, including but not limited to the use of firearms, interaction with wild animals, and exposure to outdoor conditions.

 

9.2 Hunters assume full responsibility for their own safety and the safety of their group during the hunt.

 

9.3 Huntly and the Landowner are not liable for injuries, accidents, or losses that may occur as a result of participation.

 

9.4 By confirming a booking, hunters agree that they understand these risks and voluntarily accept them as part of the hunting experience.

10. Disputes

10.1 Huntly is not a party to agreements between Hunters and Landowners. In the event of a dispute, the parties agree to first attempt resolution directly. Huntly may assist in mediation but is not obligated to intervene. Final responsibility for resolving disputes lies between the Hunter and the Landowner.

11. Account Suspension and Prohibited Activities 

11.1 Huntly reserves the right to suspend or terminate any account at its sole discretion if a user provides false information, breaches platform policies, or engages in prohibited activities.

 

11.2 Prohibited activities include but are not limited to, attempting to hunt animals not listed in a

confirmed booking, providing fraudulent or misleading documentation, engaging in unlawful

conduct, misusing firearms, violating conservation or hunting regulations, interfering with other

users’ bookings, or attempting to manipulate Huntly’s systems, or any other behaviour that Huntly, at

its sole discretion, deems harmful to the platform, its users, or its services.

 

11.3 Suspended or terminated accounts may lose access to bookings, refunds, or platform services, and Huntly may take further legal action where necessary.

12. Intellectual Property 

12.1 All content, trademarks, logos, designs, text, graphics, software, and other materials made available through Huntly are the property of Huntly or its licensors and are protected under applicable

intellectual property laws.

 

12.2 Users are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for personal, non-commercial purposes related to hunting bookings.

 

12.3 No content from Huntly may be copied, reproduced, modified, distributed, or otherwise exploited

without prior written consent from Huntly.

 

12.4 Any unauthorised use of Huntly’s intellectual property may result in suspension or termination of

accounts and may lead to legal action.

13. Privacy

13.1 Huntly processes personal information under and in terms of the provisions of the Protection of

Personal Information Act, Act 4 of 2013, and the provisions of the Company’s Privacy Policy.

 

13.2 The user herewith confirms that he/she/it read and understood the Company’s Privacy Policy and that same will be binding on him/her/it.

14. Force Majeure 

14.1 Neither Huntly nor the Landowner shall be held liable for cancellations, delays, or changes to

bookings caused by events beyond their reasonable control, including but not limited to extreme

weather conditions, natural disasters, government restrictions, disease outbreaks, strikes, or other

unforeseen circumstances.

 

14.2 In the event of a Force Majeure occurrence the Host must notify Huntly immediately.

 

14.3 The booking may be rescheduled to a later date, subject to availability.

 

14.4 If rescheduling is not possible, Huntly will issue a refund to the hunter, less applicable transfer or

processing fees.

 

14.5 Huntly does not guarantee the availability of specific species or hunting conditions in the event of

Force Majeure, and liability is limited to the refund or rescheduling options outlined above.

15. Limitation of Liability 

15.1 To the maximum extent permitted by law, Huntly shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with the use of the Platform, bookings, or hunting activities.

 

15.2 Huntly’s role is limited to acting as an intermediary booking and payment facilitation platform, and Huntly does not assume responsibility for the conduct, services, or obligations of Landowners.

 

15.3 Huntly’s total liability, if any, shall be limited to the amount of fees paid by the user to Huntly for the specific booking giving rise to the claim.

16. Foot and Mouth Disease 

16.1 You and your hunting group agree to comply with all national and farm-level biosecurity measures

relating to foot and mouth disease (FMD).

 

16.2 You confirm that neither you nor any member of your group will transport, introduce, or move animals, meat, hides, or equipment in violation of FMD regulations.

 

16.3 You must immediately disclose to the hosting farm and any relevant veterinary or regulatory authority if you or any member of your group has recently been in contact with livestock, wildlife, or hunting areas affected by foot and mouth disease (FMD). Such disclosure must be made prior to arrival at the hunting premises and may result in additional biosecurity measures, postponement, or cancellation of your booking in accordance with applicable law and farm protocols.

 

16.4 You agree to follow all disinfection, quarantine, and movement protocols required by the hosting farm or operator to prevent the spread of FMD.

 

16.5 You accept responsibility for any breach of FMD protocols by yourself or your group, including costs or damages arising from non-compliance.

17. Acceptance 

The person Accepting these Terms and Conditions:

 

i) guarantees that these Terms and Conditions will be enforceable against the him/her;

 

ii) guarantees that the he/she will comply with all of its obligations in terms of these Terms and Conditions;

 

iii) indemnifies the Company, and undertakes to hold the Company harmless against all damages, claims, costs, expenses and/or demands that the Company may suffer should the Customer fail to comply with all his/her obligations in terms of these Terms and Conditions or breaches any of its obligations in terms of or arising from these Terms and Conditions.
